TWC Wellness, LLC dba MetaboLivin’ and My Functional Pharmacist (“MetaboLivin’,” “we,” “us,” or “our”) is located in Nashville, Tennessee, USA. This Policy describes what we collect online, how we use it, when we share it, and your choices. It applies only to information collected via the Sites and our online services (email, forms, checkout, communities hosted for the Sites). It does not apply to information collected offline (e.g., live events, phone, mail).
This Policy works together with our Terms & Conditions and Disclaimer. We may update this Policy from time to time; when we do, we’ll revise the “Updated” date above. Your continued use of the Sites means you accept the updated Policy.
What We Collect
Information You Provide Voluntarily
Contact & Account Data: name, email, phone, mailing address.
Purchase & Billing Data: billing address, shipping address, order details; payments are processed by third-party processors (we don’t store full card numbers).
Forms, Opt-ins & Community: messages, survey responses, comments, support requests, course/community posts, testimonials.
Program Interactions: preferences (e.g., topics), progress, and settings inside our course portal.
Information Collected Automatically
Device/Usage Data: IP address, browser type/language, operating system, referring/exit pages, timestamps, page views, clicks, approximate geolocation (city/region level), and similar log data.
Cookies & Similar Tech: cookies, pixels, web beacons, and local storage to remember preferences, enable login, measure traffic, and personalize content/ads.
Analytics/Advertising IDs: first-party identifiers (e.g., Google Analytics cookie) and third-party identifiers (e.g., DoubleClick cookie).

How We Use Information
We use information to:
operate, maintain, and secure the Sites and services;
fulfill orders, process payments, ship products, and provide customer support;
deliver courses, memberships, and coaching communications;
personalize content, recommendations, and ads;
send transactional emails (receipts, account notices) and, if you opt in, marketing emails/SMS;
run promotions, surveys, and contests;
analyze performance, improve products, and develop new offerings;
comply with law, enforce our terms, and protect our rights, users, and the public.
Unless you opt out (see Your Choices), we may use and share information (including with service providers and advertising partners) to offer products/services that may interest you.
Advertising, Cookies & Remarketing
Google Analytics & Advertising Features
We use Google Analytics (including Remarketing, Display Network Impression Reporting, Demographics & Interests Reporting, and DoubleClick integrations). Google and third-party vendors use first- and third-party cookies to collect data about your activities on the Sites. Among other uses, this lets us:
understand traffic and trends;
remind you to complete a purchase you began;
show relevant ads to prior visitors.
Opt-outs:
Google Ads Settings: search “Google Ad Settings” and adjust your preferences.
Network Advertising Initiative (NAI) opt-out page to opt out of interest-based advertising from many third parties.
Your browser/mobile OS may offer additional ad-tracking controls.
Meta (Facebook/Instagram)
As advertisers on Meta platforms, we may collect and use data consistent with this Policy and Meta’s Data Use Restrictions. We may share ad performance data with service providers acting on our behalf, who must keep it confidential and secure. We do not use Meta ad data to build or append user profiles beyond what Meta permits, and we do not transfer Meta ad data to ad networks, data brokers, or other monetization services.
When We Share Information
We do not sell your personal information in the traditional sense. We share personal information with:
Service Providers/Processors: payment processors, ecommerce, LMS/portal, community/chat platforms, email/SMS tools, analytics, hosting, fulfillment/shipping, and IT/security vendors who help us run the Sites and services. They may be located outside your country.
Affiliates & Contractors: under confidentiality obligations and only as needed to perform work for us.
Legal/Compliance: to comply with law, subpoena, or court order; to protect our rights, users, or public safety; to detect/prevent fraud or security issues.
Business Transfers: if we sell/transfer some or all assets or merge with another entity, user information may be among the transferred assets, subject to this Policy.
We may share aggregated or de-identified data (which cannot reasonably identify you) publicly or with partners.
Links & Third Parties
Our Sites contain links to external sites and may integrate content or checkout from third parties. Their privacy practices govern their sites/services; we are not responsible for their policies or content. Review their privacy policies before providing data.
Email/SMS & Unsubscribe
If you opt in, we may send you marketing emails or SMS. Every marketing email includes an unsubscribe link; you may also reply STOP to SMS where supported. Transactional communications (e.g., receipts, service notices) will still be sent as needed to fulfill our services.
Children’s Privacy
Our Sites and services are not directed to children under 13. We do not knowingly collect personal information from children under 13. If you believe we have, contact us and we’ll delete it promptly.

General Choices
Opt out of marketing: use the unsubscribe link in emails or contact us.
Cookies/Tracking: manage via browser settings; use industry opt-out tools listed above.
Access/Update: email us to request access to or correction of your personal information.
California (CCPA/“Shine the Light”)
California residents may request: (i) the categories of personal information disclosed to third parties for their direct marketing in the prior calendar year, and (ii) the names/addresses of those third parties. Submit requests using the contact below.
Note: We do not sell personal information as defined by the CCPA; if our analytics/ads use is deemed a “share,” you may contact us to limit such sharing for cross-context behavioral advertising to the extent applicable.
GDPR/EEA/UK Residents
While we do not specifically target the EU/EEA/UK, if GDPR/UK GDPR applies, you may have rights to access, correct, delete, restrict, object, and data portability, and to withdraw consent where processing is based on consent. You also have the right to lodge a complaint with your local supervisory authority. To exercise rights, contact us (see Contact).
Data Security & Retention
We use reasonable administrative, technical, and physical safeguards to protect personal information. However, no method of transmission or storage is 100% secure. We retain personal information as long as needed for the purposes described, to comply with legal obligations, resolve disputes, and enforce our agreements.
HIPAA Notice: We are not a HIPAA-covered entity. Do not upload medical records or protected health information you do not wish to share in a coaching context.
Surveys, Contests & UGC
Participation in surveys or contests is voluntary. We use contact info to administer promotions and notify winners, and we use survey data to improve our services. Any community posts, testimonials, or user-generated content (UGC) you share may be visible to others; do not share information you wish to keep private.
Affiliate Disclosure
Some links on the Sites are affiliate links. If you click and purchase, we may earn a commission at no additional cost to you.
International Transfers
We and our service providers may process data in the United States and other countries. By using the Sites, you consent to the transfer of information to countries that may have different data protection laws than your country of residence.
Business Transfers
If MetaboLivin’ (or substantially all assets) is acquired or in bankruptcy, user information may be transferred to the acquirer and used consistent with this Policy.
Policy Changes
We may update this Policy from time to time. We encourage you to review it periodically. Your continued use of the Sites after changes become effective means you accept the updated Policy.

Standard Terms for the Purchase of Online & Taught Courses, Coaching, Retreats, Memberships, Digital Products & Supplements
These Terms and Conditions apply to services and products provided by TWC Wellness, LLC dba MetaboLivin’ and My Functional Pharmacist (“MetaboLivin’,” “we,” “us,” or “our”).

These Terms are in addition to our Website Terms, Privacy Policy, Shipping Policy, and Return Policy, and apply to the sale of any Online Course, Taught Course, 1:1 coaching, group programs, memberships, workshops, retreats, and supplements (collectively, the “Services” and “Products”). Please read carefully before purchasing.
By purchasing from us (via our websites metabolivin.com or myfunctionalpharmacist.com, or otherwise), you agree to be bound by these Terms. If you do not agree, do not purchase.
1. Definitions
Confidential Information: All non-public information shared in the course of Services.
Course Materials: All materials provided as part of our Services.
Fees: Amounts paid by you for Services or Products.
Intellectual Property Rights: Copyrights, trademarks, trade secrets, patents, and similar rights worldwide.
Online Course: Any digital course or membership content delivered online.
Taught Course: A live session delivered virtually or in person.
Services: All coaching, courses, workshops, retreats, and memberships.
Products: All physical items including supplements and merchandise.
You: The purchaser.
2. The Services
We will deliver Services as described on our Website using reasonable care and skill.
We may update, vary, or discontinue Services at our discretion.
You are responsible for determining whether Services fit your needs. We do not guarantee any particular result, outcome, or qualification.
3. Ordering & Access
Orders are offers to purchase under these Terms; we may accept or reject any order.
A contract forms when (a) we send confirmation of your purchase and (b) receive payment.
You must create an account to access some Services. Keep your login confidential.
Access to purchased group coaching is granted for the duration stated at purchase (e.g. 12 weeks). Continued group access thereafter requires an active MetaboLivin’ Membership (billed monthly until canceled).
Access to digital Course Materials continues per your plan as stated at checkout.
4. Cancellations, Refunds & Payment Terms
All sales are final. No refunds will be provided under any circumstances.
If you choose a payment plan, you agree to complete all payments. Missed or late payments may result in suspended access and referral to collections with a 20% collections fee plus attorneys’ fees and reasonable costs.
Chargebacks: If you initiate a credit card dispute, you agree to pay a $50 dispute fee per dispute.
Retreats (in-person or virtual) are non-cancelable and non-refundable; tickets may be transferred only with our prior written consent.
Payments are not installments for events; they represent the cost of digital assets and access, which cannot be “returned.”
5. Fees & Costs
Fees are shown on the Website or quoted by us.
Fees exclude sales tax, shipping, travel, and lodging unless stated otherwise.
You are responsible for all costs of attending Taught Courses or accessing Online Courses (internet, devices, travel, etc.).
6. Medical & Legal Disclaimers
No Medical Advice: MetaboLivin’ provides education and coaching only. We are not your doctor, pharmacist, dietitian, or other healthcare provider and do not diagnose, treat, prescribe, or provide individualized medical advice. Always consult your physician or qualified healthcare provider regarding medical conditions, medications (including GLP-1s, insulin, thyroid or hormone therapy), supplements, or devices.
No Guarantees: We do not guarantee weight loss, lab changes, medication reductions, or any specific results. Individual outcomes vary.
Nothing in the Services or Products constitutes medical, legal, investment, or financial advice.
If you have an emergency, call 911.
By participating, you acknowledge and accept full responsibility for your decisions, actions, and results.
7. Community Standards & Conduct
We are a faith-based, supportive community. Harassment, hate speech, solicitation, spamming, or spreading unsafe medical claims is prohibited.
We may remove you from our programs, groups, or memberships at our sole discretion for disruptive or unsafe behavior, without refund.
You agree not to solicit MetaboLivin’ clients for your own services while enrolled.
8. Intellectual Property
All Intellectual Property Rights in our Course Materials, sessions, frameworks, and recordings remain ours or our licensors’.
You may not copy, reproduce, share, resell, or use our materials to train others.
You may not record coaching or program sessions.
In exchange for Fees, we grant you a personal, non-transferable license to use Course Materials only for your own participation.
9. Confidentiality
Both parties agree to protect each other’s Confidential Information and use it only for the Services.
Confidential Information does not include information lawfully in the public domain or required by law to be disclosed.
10. Supplements, Devices & FDA Statement
Any statements about dietary supplements have not been evaluated by the Food and Drug Administration. Supplements are not intended to diagnose, treat, cure, or prevent disease.
Device data (including CGMs and wearables) may be inaccurate or incomplete. Do not use device data to make medical decisions without your clinician’s guidance.
11. Privacy, HIPAA & Data
We are not a HIPAA-covered entity. Do not upload protected health information you do not wish to share in a coaching context.
Your personal data is collected and used as described in our Privacy Policy, including use of third-party processors that may store data outside your country.
You may request to update your data by emailing kristi@myfunctionalpharmacist.com .
12. Liability
We are not liable for:
inaccuracies or reliance on content,
loss/corruption of data,
indirect, incidental, special, punitive, or consequential losses.
Our total liability is limited to the Fees paid for the specific Service giving rise to the claim.
Nothing limits liability for death/personal injury caused by our negligence, or other non-excludable liability by law.
No claim may be brought more than six months after the last date Services were provided.
13. Force Majeure
We are not liable for delays or failure to perform due to causes beyond our reasonable control, including illness, death, natural disasters, war, terrorism, strikes, or outages.
14. Age
You must be 18 or older to purchase our coaching, courses, or memberships.
15. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Tennessee, USA. Any disputes will be resolved exclusively in the state or federal courts located in Nashville, Tennessee.

17. Entire Agreement
These Terms, along with our Privacy Policy, Shipping Policy, Return Policy, and any Course-Specific Terms, form the entire agreement. They supersede any prior versions or disclaimers.
Refund Policy
Effective Date: February 5, 2026
All purchases made through TWC Wellness, LLC dba MetaboLivin’ and My Functional Pharmacist are final and non-refundable.
By enrolling in or purchasing any program, course, coaching, membership, workshop, retreat, digital product, or supplement, you acknowledge and agree to the following:
No Refunds. We do not offer refunds, exchanges, or credits for any reason, including but not limited to changes in personal circumstances, dissatisfaction with results, scheduling conflicts, or failure to participate.
Digital Access. Upon purchase, you receive immediate access to digital content, intellectual property, and/or program materials. For this reason, purchases cannot be returned.
Programs, Coaching & Memberships. Enrollment in programs, group or 1:1 coaching, memberships, and workshops is non-refundable once access is granted.
Retreats & Events. All retreat and event tickets (virtual or in-person) are non-refundable and non-cancelable. Transfers may be permitted only with prior written approval.
Payment Plans. If you select a payment plan, you are responsible for completing all payments. Failure to complete payment may result in suspension of access and referral to collections as outlined in our Terms & Conditions.
Chargebacks. Initiating a chargeback or payment dispute does not override this Refund Policy. Unauthorized chargebacks may result in fees and collection efforts as described in our Terms & Conditions.
Supplements & Physical Products. Due to safety and regulatory considerations, supplements and consumable products are non-returnable and non-refundable once shipped, unless otherwise required by law.
No Guarantees. We make no guarantees regarding outcomes, results, or experiences. Lack of desired results does not entitle you to a refund.
This Refund Policy is incorporated into and forms part of our Terms & Conditions. By completing a purchase, you agree to be bound by this Policy.

TWC Wellness, LLC DBA MetaboLivin’ and My Functional Pharmacist (“MetaboLivin’,” “we,” “us,” or “our”) provides educational coaching and resources only. By using our website, programs, courses, memberships, coaching, retreats, services, emails, social media, or any content (collectively, the “Services”), you acknowledge and agree to the following:
No Medical Care or Patient-Provider Relationship. MetaboLivin’ does not provide medical care, diagnosis, treatment, or prescriptions, and our Services do not create a pharmacist–patient, physician–patient, or other healthcare provider–patient relationship. We are not your doctor, pharmacist, dietitian, or licensed healthcare provider within the scope of these Services.
Professional Credentials Disclosure. Although our founder and/or team members may hold professional healthcare credentials, licenses, or advanced degrees, all Services are provided strictly in an educational capacity. Nothing within the Services should be construed as the practice of medicine, pharmacy, nursing, dietetics, mental health care, or any other licensed profession.
Education Only. All information is for general educational purposes and personal development. It is not medical advice, nursing advice, pharmacy advice, psychological or mental health advice, or any other professional advice.

Individual outcomes vary based on many factors, including health history, medications, adherence, clinician oversight, and personal circumstances.
Illustrative Only. Client testimonials and examples are illustrative and reflect individual experiences; they are not typical or predictive of your results.
Shared Decision-Making. Any discussions of GLP-1s, CGMs, labs, supplements, or protocols are educational and intended to help you have informed conversations with your healthcare team. You are solely responsible for your health decisions in partnership with your clinician.
Continuous Glucose Monitors, Wearables, and Data
Optional Tools. CGMs, wearables, and tracking tools are optional and may not be appropriate for everyone. Any interpretation or application of data must be reviewed with your clinician when used to guide medical decisions.
Data Accuracy. Device data can be inaccurate or incomplete. We make no warranties as to accuracy, completeness, or fitness for a particular purpose.
Faith and Mindset Content
Faith-Based Approach. Devotionals, prayer scripts, and faith-based mindset tools are spiritual support resources and are not substitutes for medical, psychological, or mental health care. If you need mental health support, seek a licensed professional.
Copyright Policy
All content, materials, frameworks, downloads, checklists, templates, videos, coaching notes, “Staying in T.U.N.E. Toolkits,” and other resources are copyrighted by MetaboLivin’ or our licensors. Any copying, reproduction, distribution, uploading, posting, or transmitting without prior written permission is prohibited.
Additional Disclosures
Scope of Services. You are purchasing educational training and/or coaching materials only. No additional support is promised beyond what is expressly stated in your specific program or in our Terms & Conditions.
Professional Advice. We do not provide legal, tax, financial, or medical advice. If you need professional services, consult a competent professional in that field.
Your Responsibility. You are solely responsible for your choices, actions, and results. By using our Services, you agree not to hold us liable for decisions you make based on our content.
Refund Policy

Limitation of Liability
To the fullest extent permitted by law, all implied warranties are disclaimed. We are not liable for any indirect, special, incidental, consequential, punitive, or exemplary damages, including loss of profits or data. Our total liability, if any, is limited to the fees paid by you for the specific product or service at issue. These limitations apply to us and our owners, officers, employees, contractors, agents, successors, and assigns.
Severability; Entire Agreement
If any provision is found invalid or unenforceable, the remaining provisions remain in full force. This Disclaimer together with our Terms & Conditions and Privacy Policy constitute the entire agreement regarding your use of our Services.
